Terms of Service — MAD Education
MAD Education (ABN 18 606 644 508) is a business registered in Victoria, Australia. These Terms of Service govern your access to and use of our courses, webinars, and related content ("Services"), and apply from the point you create an account or make a purchase. This document is governed by the laws of Victoria, Australia and the Commonwealth of Australia.
1. Access and licence. On payment, we grant you a personal, non-exclusive, non-transferable licence to access the purchased course or webinar content for your own professional use. You may not reproduce, redistribute, resell, publicly share, or use course materials to train or instruct other individuals without our prior written permission.
2. Account terms. You must provide accurate registration details and keep your login credentials confidential. You are responsible for all activity under your account. Accounts are for individual use only unless a group licence has been separately agreed.
3. Payment. Fees are as displayed at checkout and processed via our third-party payment provider. We do not store your full payment card details. Prices may change for future purchases but will not retrospectively affect content you have already paid for.
4. Refunds. Refunds are available within 7 days of purchase for on-demand courses not yet substantially completed, and for webinars not yet attended. Where the Australian Consumer Law entitles you to a remedy — for example, a major failure to supply the Services as described — that remedy applies regardless of any other term of this policy.
5. Live webinars. Webinars are scheduled for a specific date and time and delivered via third-party platforms outside our control. We are not liable for attendance issues caused by your own internet connection, device, or the platform provider's outages. If a webinar is cancelled, materially altered, or not delivered due to a failure on our part, your Australian Consumer Law remedies (e.g. a rescheduled session or refund for a major failure) remain available.
Live webinars may be recorded, including audio, video, screen-share, and Q&A/chat content, and reused as on-demand course content. By attending with your camera, microphone, or chat active, you consent to being recorded and to your questions (excluding your name or identifying details, where reasonably practicable) being included in that recording. To avoid being recorded, keep your camera and microphone off and submit questions in a form allowing us to anonymise them before reuse.
6. Acceptable use. You must not share your account credentials, redistribute or publish course or webinar recordings, attempt to circumvent access restrictions, or use the Services for any unlawful purpose.
7. Intellectual property. All course materials, recordings, trademarks, and branding remain the property of MAD Education or its licensors. Purchasing access grants you a licence to use the content as set out in clause 1 — it does not transfer ownership of any intellectual property.
8. Suspension and termination. We may suspend or terminate your access if you breach these Terms, including unauthorised sharing or redistribution of content. You may stop using the Services at any time; this does not entitle you to a refund except as set out in clause 4 or required by law.
9. Liability. To the maximum extent permitted by law, MAD Education excludes all liability for any loss, injury, or damage arising from your use of the Services. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or other right under the Australian Consumer Law that cannot lawfully be excluded, including your rights in relation to services not provided with due care and skill.
10. Indemnity. You agree to indemnify MAD Education against any loss or claim arising from your breach of these Terms or your misuse of the Services, except to the extent caused by our own negligence or breach.
11. Privacy. Our collection and handling of your personal information is set out in our Privacy Notice — see that document for details, including in relation to webinar recordings.
12. Changes to these Terms. We may update these Terms from time to time; changes apply prospectively and will not reduce your access to content you have already purchased, except where required by law. Continued use of the Services after an update constitutes acceptance of the revised Terms.
13. Disputes and governing law. These Terms are governed by the laws of Victoria, Australia. Before pursuing formal action, please contact us at [email protected] so we can try to resolve the issue directly.
